  1. AMI understands that you care about privacy, so we are committed to helping you understand your privacy rights and how we use information about our site visitors. This Privacy Policy describes the types of information we collect, how we may use that information, to whom and under what circumstances we may disclose it, and how we protect it. We also tell you how to update your information or contact us with questions about our privacy practices. This Privacy Policy applies only to this website (www.amientertainment.net), our mobile sites and mobile applications, and our use of social media sites (collectively, the "Sites"), and any other personal information obtained when you call, email, or otherwise communicate with AMI. By accessing the Sites on any computer, mobile phone, tablet, or other device, making a purchase from AMI, or otherwise interacting with AMI, you agree to the terms of this Privacy Policy. If you do not agree to the policy, please do not use the Sites.
    We suggest you review this Privacy Policy periodically, as it may be updated from time to time. We will post a current version on the Sites.
  2. What kind of personal information does AMI collect from you? As a general matter, we collect and record information about your use of the AMI Web Site and your Digital Jukebox and your Tap TV System. We collect personal information which consists of your name, postal mailing address, e-mail address, telephone number, age, birth date, what music you select, what TV channels are selected, how long making that selection takes you, the amount of times any particular song is downloaded onto the Digital Jukebox hard drive, as well as financial data concerning your jukebox or Tap TV System. We may seek to collect more personal information while you use our Web site, and we may keep a record of any correspondence you have with an AMI representative through the AMI Web Site. We may collect your location information, including the location of your Digital Jukebox or Tap TV System as personal and AMI may share that information with others. You may, however, opt out of certain AMI uses of your location information by following our opt out procedures set forth below.
  3. For what purposes does AMI collect personal information from you? We may use the information we obtain about you for a variety of purposes, including: providing information or services you requested, such as creating your AMI account or subscribing to programs we offer; communicating with you about our products, services, offers, events, and promotions; processing and fulfilling transactions, such as product purchases; providing customer support; gathering feedback about our products, services, and programs; providing customized or targeted content and promotions/discounts based on your use of the Sites, your preferences, your purchases, and/or your location, depending on the type of information you have chosen to provide to us; operating, evaluating, enhancing, and improving our business, products, services, communications, and similar activities; analyzing, enhancing, and improving our online features, marketing communications, and marketing strategies; protecting against and preventing fraud, physical and financial loss, unauthorized transactions, claims, and other liabilities, and managing risk, including identifying unauthorized users or other security issues; complying with applicable legal requirements, industry standards, and our policies, or enforcing compliance with those requirements; and in the case of our careers pages, evaluating job candidates and making hiring and other personnel decisions.
    If you do not wish to receive communications from us about special offers and promotions, you can opt-out of receiving these communications by following the instructions contained in the messages you receive. Even if you opt-out of receiving these messages, we reserve the right to send you certain communications relating to the services we provide, and we may send you service announcements and administrative messages. We do not offer you the opportunity to opt-out of receiving those communications.
    We also may combine information we collect about you with other information we receive from additional sources. You may choose not to provide us with all of the information we request. In some cases, choosing not to provide information may prevent you from taking full advantage of our Sites' features.
  4. How does AMI share your personal information? AMI does not sell, rent, trade, license or otherwise disclose your specific personal information or financial information to anyone other than to affiliates under AMI Entertainment Network's control, except that:
    We may share personal information with trusted parties, such as service providers who assist us in our business and who are only permitted to use your information in ways we have authorized or to comply with legal requirements. These trusted parties include: our subsidiaries and affiliates; trusted business partners, such as companies we partner with for joint projects or promotions, and service providers, to perform a business, professional or technical support function for us; when reasonably requested or required by law enforcement authorities or other government officials; when required by law or in response to legal process; when we believe disclosure is appropriate to prevent physical harm or financial loss; when reasonably necessary to an investigation of suspected or actual illegal activity; and in the event we sell or transfer all or a portion of our business or assets; as necessary if we believe that there has been a violation of the Sites' Terms of Service or of our rights or the rights of any third party; and we may also disclose your personal information with your express consent.
  5. What is aggregated information? Aggregated information is general information about you, the Sites, your jukebox and/or the Tap TV System that AMI combines with general information about other visitors so that AMI knows, generally, how the Sites and the jukeboxes and Tap TV Systems are used. When you visit the Sites, we collect information about you via cookies (explained below). We do this so that we can try and improve your overall experience when you use the Sites again. We collect information about traffic patterns on the Sites (like how many people visit us and when) and about what songs are most frequently selected. Aggregate information helps us to make decisions like what kind of music programming or TV programming to offer, and how to modify our page design to make the selection process easier.
    It is AMI's policy that aggregated personal information is the only type of information that will be given to third parties (except as set forth in Section 2 of this Privacy Policy), and it will only be given to them in a format where individual users are not personally identified. By way of example, we may tell a record company, publisher, or another operator statistics like, "500 operators selected a particular song in the last week."
  6. How and why does AMI use "cookies" to collect information? A cookie is a small data file that a Web site can write to your hard drive for internal reporting and record keeping purposes. Generally, cookies are used by AMI to measure activity on the AMI Web Site (how many operators selected a particular song, how long did it take to process the selection). Cookies also allow us to make improvements and updates to the AMI Web Site based on which searches and selections are popular and which are not. In addition, cookies allow AMI to store and retrieve login information such as "remembering" your login name, identifying the Web sites you visit, and assisting us in processing your selections. AMI may use cookies to store and track information about you in order to send you offers on new services or products AMI (or one of its subsidiaries or affiliates) may be offering.
    Most browsers allow you the option to block or erase cookies from your computer. Please be advised, in the event you do so, we may not be able to securely process your selection.
    Remember, you may occasionally get cookies from our advertisers or partners, which is standard in the Internet industry. AMI does not control these cookies, and these cookies are not subject to AMI's Privacy Policy.
  7. How and why does AMI use web beacons to collect personal information? Our Sites may use web beacons, pixels, javascript, or other electronic markers that monitor some types of use. These beacons may provide us with information such as the IP address of the computer or other device you used to access our Sites. We use this information to understand patterns of activity on our Sites, to improve features, and to customize our presentation of content to our users. We may work with service providers that help us track, collect and analyze this information.
  8. What about the privacy policies of links on AMI? We may provide links to other websites for your convenience and information. Since these sites are not owned, controlled, or operated by AMI, we cannot control how information collected by these linked sites will be used, shared, or secured. If you visit linked sites, we strongly suggest that you review the privacy notices or policies posted at those sites. We are not responsible for the content of linked sites, your use of them, or the information practices of their operators.
  9. What does AMI do with my general information? We may match information obtained from cookies with data provided by you through customer service correspondence, through the Digital Jukebox, by your use of the AMI Web Site, etc., and analyze this data both in the aggregate (to learn broad statistics about our users) and specifically (to learn about your specific programming and your Digital Jukebox or the Tap TV System's success). This information lets us personalize our services to you and improve the content and design of the AMI Web Site. We also provide aggregate analysis of our users to prospective and current partners, advertisers, and other third parties.
  10. Your Choices. We offer you certain choices about the information we collect, how we use and share information, and how we communicate with you. To help protect your privacy, when you exercise these choices we may take reasonable steps to verify your identity, such as requiring a password.
    By contacting us as shown in the "Contact Us" section of this Privacy Policy, you may opt-out of receiving communications from us, such as newsletters and surveys. You also have the following specific opt-out choices:
    • Marketing communications. You may opt-out of specific communications (such as marketing emails, rewards program emails, and customer satisfaction surveys) by following the opt-out instructions contained in the footer of each communication or contacting Customer Service as provided below. In certain jurisdictions, we will market to you only with your express consent.
    • Cookies. Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. However, rejecting cookies may affect your user experience, and you may not be able to access or use certain features of our Sites. In addition, disabling cookies may invalidate opt-outs that rely on cookies, such as web analytics or targeted advertising opt-outs. Because AMI does not own or control browser tools, we cannot guarantee their effectiveness.
    • Mobile devices and geographic location. When you use our website on your mobile device, you may choose not to share your location with us by adjusting the device's location services settings. You may opt out of sharing your location information in your profile by following these steps: 1). Log onto the AMI Web Site at (www.amientertainment.net) with your operator executive login id. 2). Press the location tab to display all of your locations. 3). Select the location in question by clicking on the location name. 4). Review and update any options for use of the location information. These can be found at the top of the location details section. 5). Press "Save Changes" to save your preference.   11. Retention of Personal Information. Personal information that we collect, access or process will be retained only as long as necessary for the fulfilment of the purposes for which it was collected, unless otherwise provided in agreements between you and AMI or as required or authorized by law. Personal information that is no longer required to fulfill the identified purposes will be destroyed, erased or made de-identified.
  12. Children's Privacy Protection. AMI's Sites are not directed at children under the age of 13 and AMI does not knowingly solicit or collect personal information from children under 13 without prior verifiable parental consent. If AMI learns that a child under the age of 13 has submitted personal information to us without parental consent, we will take all reasonable measures to delete such information from our databases and/or to not use such information for any purpose (except as necessary to protect the safety of the child or others as required or allowed by law). If you become aware of any personal information we have collected from a child under 13, please contact us.
  13. California Residents. If you are a California resident, you may contact us to request information about circumstances in which we share certain personal information with third parties for their marketing purposes and allow third parties to collect such information from our Sites. To request information please contact us as indicated in the "Contact Us" section of this Policy.
  14. Right to Removal of Posted Information-California Minors. If you are under 18 years of age, reside in California, and have a registered account with AMI, you have the right to request removal of unwanted information that you publicly post on our Sites through customer reviews or other methods. To request removal of such information, you can contact AMI at the phone number or postal address below. Upon receiving such a request, AMI will make sure that the information is not publicly available on our Sites, but the information may not be completely or comprehensively removed from AMI's systems.
  15. Data Transmission. Please be advised that information described in this Privacy Policy will be maintained and processed in the United States. Other countries, including the United States, may not have the same data protection laws as the country in which you reside. No matter where we process personal information, that information will be subject to the policies and protections described by this Policy.
    We make reasonable efforts to ensure that your information is relatively secure on our system. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, we cannot guarantee the complete security of any information, general or otherwise, that you transmit to us, and you do so at your own risk.
  16. Visitors from Outside the United States-Cross-Border Transfer. The Sites are hosted in the United States. If you are visiting the Sites from outside the United States, your information may be transferred to, stored and processed in the United States or other countries in accordance with this Privacy Policy. The data protection and other applicable laws of the United States or other countries may not be as comprehensive as those laws or regulations in your country or may otherwise differ from the data protection or consumer protection laws in your country. Your information may be available to government authorities under lawful orders and law applicable in such jurisdictions. By using the Sites and/or providing personal information to us, you consent to transfer of your information to our facilities as described in this Privacy Policy.
  17. Do Not Track Disclosure. Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt-out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, AMI does not recognize DNT.   18. Information Security. The nature of our business requires us to collect and maintain certain personal information, and we understand that we have a responsibility to protect it. To do so, we maintain appropriate administrative, physical, and technical safeguards that are designed to safeguard your personal information from accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use. Your AMI account is protected by your log-in credentials, which you must keep secure and confidential. We also use the Hypertext Transfer Protocol Secure (HTTPS) communications protocol in many areas of the site where we ask users to submit information.
    We communicate our privacy and security guidelines and standards to AMI employees who access personal information for purposes described in this Privacy Policy, and we enforce these requirements within the company. We also require that our service providers protect your personal information and use it only in the ways we have authorized.
    AMI endeavors to maintain accurate information and provide you with options to update your information. You can log into your account and modify your information using your log-in credentials. You also may request that we update your information by contacting us as described in the "Contact Us" section of this Policy.
  19. General Safety Tips. For your own information and protection on the Internet in general, keep in mind that whenever you voluntarily disclose personal information, that information can be collected and used by others. Similarly, if you post personal information in public places, you may receive unsolicited e-mail messages. You should also be aware that e-mail is not an encrypted method of communicating, and therefore is not a secure method of transferring credit card numbers. If we change the policy in a material and retroactive manner, we will provide appropriate notice to you.
